§ 10-27. Expiration; renewal.

  • (a)

    Upon expiration of the initial term of a license, the city shall have the right to:

    (1)

    Renew or extend the license in accordance with the Cable Act, if the city or the licensee requests such renewal in a timely manner; or

    (2)

    Deny license renewal subject to applicable provisions of federal law; or

    (3)

    Purchase the cable system for fair market value as provided under the Cable Act; provided that no right to purchase the cable system shall apply with respect to facilities lawfully in use for the provision of non-cable services as to which no franchise or license from the city is required or as to which any franchise or license that is required from the city has been obtained.

    (b)

    If a licensee fails to seek renewal in a timely manner under the Cable Act, then the licensee shall comply with the provisions of the application process specified in article II if the licensee wants to continue operating a cable system within the city.

    (c)

    Any lawful action to revoke a license for cause shall not be negated by the subsequent initiation or pendency of renewal proceedings or the filing of a new application or proposal by a licensee.
