§ 10-29. Continuity of service mandatory.

  • (a)

    It shall be the right of all subscribers to continue receiving cable service during the term of a license insofar as their financial and other obligations to a licensee are honored.

    (b)

    If a license is terminated, the licensee shall cooperate with the city to ensure continuity of cable service to all subscribers for a period of at least thirty (30) days. The licensee shall be entitled to all revenues for any such period during which it operates the cable system.

    (c)

    If a licensee fails to operate the cable system for five (5) consecutive days without prior approval of the city or without just cause, the city may, at its option, operate the cable system or designate an operator until such time as the licensee restores cable service to the standards required by its license or a new permanent operator is selected. If the city is required to fulfill this obligation for a licensee, the licensee shall reimburse the city for all reasonable costs and damages that are the result of the licensee's failure to perform.
