§ 10-109. Rights reserved to the city.

  • (a)

    Neither the granting of any license nor any provision of this chapter shall constitute a waiver of or bar to the exercise of any governmental right or power of the city. There is hereby reserved to the city the power to amend any section of this chapter as to require additional or greater standards of construction or operation of cable systems or otherwise pursuant to the city's lawful police powers.

    (b)

    If any state or federal law or regulation shall require or permit a licensee to perform any service or shall prohibit a licensee from performing any service, in conflict with the terms of its license or any law or regulation of the city, then as soon as possible following knowledge of such perceived conflict, the party asserting that such conflict exists shall notify the other party of the conflict. If the city determines that a material provision of this chapter or a license is affected by any action or the state or federal government, the city shall have the right to modify any of the affected provisions to such reasonable extent as may be necessary to carry out the full intent of this chapter and the license consistent with state or federal law
