§ 18.5-5. Permits.

  • (a)

    All grading and drainage permit requirements, limitations, conditions and fees shall be in accordance with the current edition of the city's "Design Guidelines for Site Development and Infrastructure Construction," which document has been adopted by the city and is on file in the office of the city clerk. Grading plans and permits are required in all cases to include the stockpiling of earth materials for future operations and the temporary storage of earth materials for operations at other locations. The purpose of requiring plans and permits for these storage operations is to protect the general public welfare.

    (b)

    When grading operations or other construction disturbs or affects an area of over five (5) acres, a national pollutant discharge elimination system (NPDES) permit may be required by the federal environmental protection agency (EPA) in addition to permits required by the city.

    (c)

    A grading plan and permit are required in all cases except:

    (1)

    Grading operations involving the movement of less than fifty (50) cubic yards of earth material.

    (2)

    Excavation of earth material for the purpose of installing a decorative pool or swimming pool on a single-family lot. Any excess earth material generated by pool excavation shall be disposed of in a manner consistent with the City Code.

    (3)

    Trenching for the purpose of installing underground utilities.

    (4)

    Other movement of earth material that may be exempted by the city engineer.

    (d)

    Penalties for failure to obtain a grading permit are given in section 18.5-15, penalties for violations, this chapter.
