§ 18.5-17. Appeals.

  • (a)

    Any person aggrieved by a decision of the city engineer under this chapter may appeal the decision to the city council. The appeal shall be initiated by delivery to the city clerk a letter and supporting documentation requesting city council review of the city engineer's decision. Requests for appeal should address specific areas of disagreement with the city engineer. The city clerk shall forward the appeal request to the city engineer for the preparation of necessary documentation to place the appeal on a council agenda.

    (b)

    The decision of the city engineer may be reversed or modified by the city council upon considering the following factors along with any other pertinent considerations:

    (1)

    The true intent of this chapter would not be affected by the decision;

    (2)

    The provisions of this chapter do not fully apply to the circumstances; or

    (3)

    That a manifest injustice would be done by the decision.
