§ 18-3. Powers and duties of administrator.

  • (a)

    In order to protect the health and safety of the people of the City, the Administrator, is authorized and directed to adopt any reasonably necessary ordinance, resolution, rule, procedure, policy or practice to establish, implement and ensure compliance with the provisions of this chapter to control the storage, collection, disposal and salvaging of solid waste and recyclable material within the City. The Administrator is further authorized to provide disposal sites for refuse originating within the City and to provide and/or approve of recyclable material collection sites, so that refuse and recyclable materials may be safely and expeditiously collected, managed, treated, stored, disposed of and/or recycled. The Administrator is also authorized to regulate the development, construction, maintenance, and operation and closure of such sites.

    (b)

    The Administrator may adopt rules for the collection, management, treatment, storage, recycling and disposal processes, such as determining types of wastes that may be disposed of, routing of traffic and designating time and location that dumping may occur in landfills. Additionally, the Administrator may prescribe rules for the delivery of recycling services and commercial or industrial solid waste management services, to promote the availability of such services, and to provide competition in the delivery of such services within the City in accordance with A.R.S. § 49-746.
