§ 21-41.02. Property holds by non-city agencies; contested claims; releases.

  • Whenever a law enforcement agency other than the city's police department has placed a hold on property and such agency has actual knowledge that a person other than the licensee claims the right to possession of the held property, the following procedures shall govern the release of the hold and/or the property:

    (a)

    If the agency takes custody of the held property after placing the hold, then the property hold shall automatically terminate at such time as the agency takes custody of the property. The agency shall then determine its own procedures concerning any subsequent release of the property, and the hearing procedures set forth in section 21-41.03 shall not apply.

    (b)

    If the agency does not take custody of the held property after placing the hold, the agency shall determine its own procedures for releasing the property hold; provided, that every property hold shall automatically terminate ninety (90) days after it is placed if the agency has not otherwise released the hold by the end of such ninety-day period.
