§ 21-161. Definitions.

The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Open-air market: A retail market consisting of multiple participants who operate from one general business location which is not a permanent enclosed structure, under the control of a common operator or operators, on an irregular or semi-regular basis and who display, trade, barter, buy or sell new merchandise at such location.

Operator: Any person who directly or indirectly controls the admission of participants or merchandise into the selling or trading area of an open-air market or park-and-swap operation.

Operator's license: A license issued to the operator of an open-air market or park-and-swap operation pursuant to this article, excluding transaction privilege licenses.

Park-and-swap operation: A market consisting of multiple participants who operate from one general business location, under the control of a common operator or operators, on an irregular or semi-regular basis and who display, trade, barter, buy or sell used merchandise at such location, regardless or whether new merchandise is also displayed, traded, bartered, bought or sold at such location.

Participant: Any person who brings merchandise to an open-air market or park-and-swap operation for purposes of displaying, trading, bartering or selling such merchandise at such market or operation.

Persons financially interested: For a corporation, any person who is the beneficial owner of at least fifty percent (50%) of the shares of such corporation; for a noncorporate business, any person who shares in, directly or indirectly, at least fifty percent (50%) of any financial gain attributable to such business as an owner, proprietor or otherwise.

Police chief: Chief of the City of Glendale police department.

Tax code: The city's transaction privilege license tax code as set forth in chapter 21.1 of this Code (Article II of this chapter).
