§ 21-180. Definitions.

  • In this article, unless the context requires otherwise:

    (1)

    Applicant means the person who applies for a license pursuant to this article.

    (2)

    Automated kiosk means an interactive device that is installed within a retail space and with which used consumer electronic devices are sold, traded, recycled, or otherwise received by a person.

    (3)

    Automated kiosk license means a license issued pursuant to this article authorizing a person to operate one or more automated kiosk(s) within the boundaries of City of Glendale.

    (4)

    Consumer electronic device means any portable electronic or digital device designed to be purchased and used by end users or consumers for daily, non-commercial purposes; examples of consumer electronic devices include, but are not limited to, cellular telephones, touch screen tablets, laptop computers, smart watches, and digital media players.

    (5)

    Controlling person means a person who either (A) has a ten (10) percent or greater interest in the ownership or earnings of the applicant, or (B) is any of the following:

    a.

    An officer, director, or any stockholder who owns ten (10) percent or more, of a corporation licensee/applicant;

    b.

    A general partner of a limited partnership licensee/applicant or partner of a non-limited partnership licensee/applicant;

    c.

    An officer, president, or secretary of a limited liability company/corporation licensee/applicant; or

    d.

    The sole proprietor of a sole proprietorship licensee/applicant.

    (6)

    Designated Agent means the person designated by the applicant or licensee to receive notices from the City of Glendale pursuant to this article.

    (7)

    ESN means a unique number assigned by the manufacturer to identify a mobile phone or device, commonly referred to as an electronic serial number.

    (8)

    IMEI means a unique number used by wireless carriers and cell phone manufacturers to identify mobile phones and devices, commonly referred to as an international mobile equipment identity.

    (9)

    Licensee means the person who applied for a license pursuant to this chapter and in whose name such license was issued by the City of Glendale pursuant to this article.

    (10)

    MEID means a unique identifier used by wireless carriers and cell phone manufacturers to identify a mobile phone, commonly referred to as a mobile equipment identifier.

    (11)

    Person means an individual, partnership, corporation, association or any other entity of whatever kind or nature.
