§ 25-55. Smoking optional areas.

  • Other provisions of this article to the contrary notwithstanding, the following areas shall not be subject to the smoking restrictions of this article:

    (1)

    Private residences.

    (2)

    Bars, pool or billiard rooms and bowling centers.

    (3)

    Hotel and motel rooms rented to guests.

    (4)

    Retail stores that deal exclusively in the sale of tobacco products and smoking paraphernalia.

    (5)

    On-stage smoking as a part of a stage production, ballet or similar exhibition.

    (6)

    Hotel and motel conference or meeting rooms, and all other public and private conference or meeting rooms, while these places are being used exclusively for private functions.

    (7)

    A private residence which serves as a place of employment.

    (8)

    Private clubs and private recreation facilities.

    (9)

    Public areas of restaurants that conspicuously post a notice outside each public entrance that the restaurant does not provide nonsmoking areas in accordance with this article.
