§ 26-36. Definitions.

  • The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Confinement: Any limits or conditions placed by a jailer or other authorized person upon the movement, liberty or actions of any prisoner by any means whatever, and shall include, but shall not be limited to, confinement in any jail, hospital, building, structure or other area.

    Escape: The unlawful departure of a prisoner from the limits or conditions of his custody or confinement and shall include, but shall not be limited to, the voluntary leaving of the enclosure or limits of the city jail or other place of confinement, within or without the city jail contrary to any law or the instructions of a jailer or other authorized person, the violation of the instructions of a jailer or other authorized person to return when released for a temporary period of time, the violation by a jail trustee or other prisoner given limited or conditional liberties of the limits and conditions imposed upon such trusty or prisoner, the voluntary assumption by any prisoner of any freedom or liberty, not expressly permitted by any law or the instructions of a jailer or other authorized person.
