§ 28-82. Findings of fact.

  • The council finds as follows:

    (1)

    That the provision of park land open space and recreational facilities is an essential service which the city must provide in an attempt to satisfy the environmental, psychological, health and aesthetic needs of its citizens;

    (2)

    That the park land open space and recreation facilities now provided by the city are intended and adequate only for the needs of current residents;

    (3)

    That the development of new neighborhoods will necessitate expenditures for park acquisition and the development of recreation facilities to meet the leisure needs of these new residents;

    (4)

    That new developments, neighborhoods and residents will derive direct and specific benefits from the improvements that will be created with funds obtained from the fee or tax assessed herein; and

    (5)

    That the fee or tax assessed herein is based on definite standards presented to, and approved by, the council and that it bears a reasonable relationship to the burden imposed on the city in providing park land open space and recreation facilities for new developments and residents.
