§ 2-251. Exemptions from provisions.

  • The provisions contained in this article shall not apply to the following categories of abandoned personal property:

    (1)

    Firearms, weapons and other devices or instruments designed for inflicting bodily injury. The city may elect to dispose of or retain the same.

    (2)

    Items for which no bids are received or bids received are less than the cost of advertising or selling. Such items may be deemed to be of no intrinsic or monetary value and may be disposed of in any manner deemed appropriate by the city.

    (3)

    Items useful or necessary to the city. Such items may be retained by the city for its use.

    (4)

    At the discretion of the city manager or his designee, the city may elect to donate any abandoned personal property or exempted item in its custody for at least ninety (90) days to a governmental or nonprofit or charitable organization.
