§ 32.5-3. Definitions.

  • For the purpose of this chapter, the following words, terms and phrases shall have the meanings respectively ascribed to them by this section; and any word, term or phrase not specifically defined in this section shall be defined by reference to state law, city ordinance, or other persuasive authority:

    Developer/redeveloper: Any individual, firm, corporation, partnership, association, syndication, trust, governmental agency, school district, or other legal entity that is responsible for the development or redevelopment of land.

    Development/redevelopment: Any project which is included in the criteria for development plan review as discussed in Article XXIX.I, section 102.2, of Appendix A of the Code, as follows:

    (a)

    Any new development or construction or change of use;

    (b)

    Any expansion of an existing site or building;

    (c)

    Any remodeling of an existing use that alters at least twenty percent (20%) of the floor area or site area; or

    (d)

    Any remodeling or improvement valued at fifty percent (50%) or more of the value of existing improvements on the site.

    Existing utility poles and lines: Utility poles and lines that are in place and in operation within ninety (90) days of the effective date of this chapter.

    New utility poles and lines: Utility poles and lines that are not in place and in operation within ninety (90) days of the effective date of this chapter.

    Normal maintenance and repair: Those routine or emergency operations conducted by a utility company to repair and/or replace damaged or inadequate conductors or supporting poles. Operations which result in an increase in the number of conductors or number of poles shall not be construed as normal maintenance but shall be categorized as a system upgrade which will require undergrounding. Maintenance and repair will include the practice of "overlashing" a new conductor on an existing, inoperative conductor.

    Offsite: All easements within and rights-of-way within and adjacent to the development. Adjacent rights-of-way will include property extending from the developer's property lines to the centerline of the adjacent rights-of-way.

    On-site: The individual lots, parcels, tracts, or structures of the development.

    Power line extensions: Those primary distribution lines that are to be extended through either a developed or undeveloped area.

    Primary distribution line: An electric line used for electrical distribution of electrical feeder, single-phase or three-phase, having a voltage rating of twelve thousand five hundred (12,500) volts or less.

    Secondary and service lines: Those utility lines that provide electrical and communications service.

    System upgrade: Any modification of an overhead utility system that results in an increase in the number of conductors or the number of supporting poles. The addition of a service line to an existing residence or other structure currently being served by an overhead system shall not be construed as a system upgrade.

    Transmission line: An electric line used for the bulk transmission of electricity between generating or receiving plants and major subdivisions or delivery points, having a voltage rating greater than twelve thousand five hundred (12,500) volts.

    Underground (undergrounding): The placement of utility lines below ground, with the removal of above-ground poles, wires and structures as applicable.

    Utility company: The companies, corporations and municipalities who undertake distribution and transmission of electricity, telephone, data, telegraph, radio, television, or telecommunications.

    Utility poles and line: The poles, structures, wire, aerial cables and related facilities used in the distribution and transmission of electricity, telephone, data, telegraph, radio, television, or telecommunications.
