§ 5-4. Carnivals, circuses, haunted houses and exhibitions.

  • (a)

    Persons operating carnivals, circuses, haunted houses or exhibitions shall provide fireproof tents and safe structures in accordance with the rules and regulations of the city fire department and division of building inspection.

    (b)

    All circuses, carnivals, haunted houses and exhibitions must provide such special security guards as may be required and approved by the chief of police to insure the protection of the public.

    (c)

    Every licensee authorized to operate a circus, carnival, haunted house or exhibition shall post with the tax and license division one hundred dollars ($100.00) in advance to insure the payment of the city privilege license tax, which shall be returned to the licensee upon satisfactory payment of the privilege license tax.

    (d)

    No person shall be issued a license to operate a circus, carnival or exhibition at which rides are used or undomesticated animals are exhibited until such person has filed with the city's risk management division an approved certificate of insurance certifying that the applicant carries public liability and property damage insurance, issued by an insurance carrier acceptable to the city, insuring the applicant against claims arising out of the operation of such circus, carnival or exhibition in amounts not less than five hundred thousand dollars ($500,000) per person and one million dollars ($1,000,000) per occurrence for personal injuries or death and not less than one hundred thousand dollars ($100,000) for property damage. Each licensee shall maintain such liability insurance at all times during which he or she operates such circus, carnival or exhibition within the city.
