§ 5-70. Public hearing; background check.

  • (a)

    Upon receipt of an application for a bingo license, the city shall set a public hearing on such application within the time limits set forth in Arizona Revised Statutes section 5-404(I), as amended. Prior to the hearing, the chief of police or his or her designee shall conduct a background check of the applicant and the applicant's manager. Such background check shall include fingerprinting and photographing the applicant's manager and a criminal history check of the applicant's manager. After the public hearing, the city shall recommend approval or disapproval of the application and forward the original or certified copy of the application endorsed with the city's approval or disapproval thereof to the licensing authority. If the application is disapproved, the endorsement shall contain the specific reasons for disapproval.

    (b)

    Upon receipt of an application for a location transfer for a bingo license, the city shall set a public hearing on such application. After the public hearing, the city shall recommend approval or disapproval of the application. If the application is approved, the city shall furnish the licensee with a written recommendation of approval for the licensee to submit to the licensing authority.
