§ 10-11. Application for initial license.

  • Each application for an initial license to construct or operate a cable system in the city shall be filed with the office of the city clerk and shall be on forms prescribed or approved by the city manager. Each application shall include the following information:

    (a)

    The applicant's name, address and telephone number;

    (b)

    A detailed statement of the business entity organization of the applicant including the following:

    (1)

    The names and addresses of all officers and directors of the applicant;

    (2)

    The names and addresses of all persons and entities having a ten percent (10%) or larger share of the ownership of the applicant and the respective ownership share of each such person or entity;

    (3)

    The names and addresses of any affiliate of the applicant and a statement describing the nature of any such affiliate relationship;

    (4)

    Such financial information as the city manager may deem necessary to evaluate the applicant's financial ability to construct and operate a cable system, including a financial plan (pro forma), if necessary;

    (5)

    A statement identifying the five (5) largest cable systems operated by the applicant or its affiliates within the United States; and for each such cable system, the name, address and telephone number of the primary contact person at the licensing authority from whom the city can obtain additional information about the cable system.

    (c)

    A detailed description of the proposed plan of operation of the applicant which shall include the following:

    (1)

    A map indicating all areas proposed to be served in the applicant's initial service area, a proposed time frame for the installation of all equipment necessary to become operational throughout the initial service area and a line extension policy for any undeveloped areas of the city not included in the initial service area for which a specific service time frame cannot presently be determined;

    (2)

    A statement describing the equipment and operational standards proposed by the applicant;

    (3)

    A statement setting forth all agreements, whether formal or informal, written or oral, between the applicant and any third party which materially affect the applicant's legal, financial or technical qualifications to construct or operate a cable system.

    (d)

    A copy of any agreement concerning the license area between the applicant and any provider of local facilities to be used as a part of the cable system, including the use of such provider's poles, lines or conduits; and

    (e)

    Any other information which the city manager determines to be necessary to evaluate the applicant's legal, financial and technical qualifications to construct and operate a cable system.
