§ 10-62. Damage to cable system during an emergency.

Subject to this code and Arizona statutes, the city shall have the right, because
of a public emergency, to sever, disrupt, dig up or otherwise destroy facilities of
a cable system, without any prior notice to a licensee, if such action is reasonably
deemed necessary by the city manager, fire chief, police chief, transportation director,
city engineer, public works director or utilities director. A public emergency shall
be any condition which, in the reasonable opinion of any of the officials named, poses
an immediate threat to the lives or property of the residents of the city, caused
by any natural or man-made disaster, including storms, floods, fire, accidents, explosions,
major water main breaks and hazardous material spills. As between the city and a licensee,
the licensee shall be responsible for repair of its facilities damaged pursuant to
any such action taken by the city.
