§ 10-64. Construction permits.

  • (a)

    A licensee shall obtain all necessary construction permits prior to constructing, removing, abandoning, relocating or reconstructing any portion of its cable system, except for repairs of an emergency nature. A licensee, as a part of submitting construction plans to obtain a permit, shall provide the city with a description of the cable service to be provided by the licensee using that portion of its cable system in sufficient detail for the city to determine compliance with this chapter.

    (b)

    In the case of emergency repairs, a licensee may obtain oral approval for the repair from the appropriate city personnel. In such cases, a licensee shall later file plans and obtain a permit as soon as possible. Whenever the facilities or related construction activity of a licensee creates a serious hazard to public safety or welfare, the licensee shall take all necessary actions to immediately abate the hazard. If a licensee cannot contact the city immediately, the licensee shall proceed to abate the hazard immediately and shall notify the city, file plans, obtain a permit and make any required changes as soon as possible.
