§ 18.5-15. Penalties for violations.

  • (a)

    Any person violating any of the provisions of this chapter shall be guilty of a Class I misdemeanor. Every such person shall be deemed guilty of a separate offense for each day during which, or any portion of which, such violation continues and shall be punishable therefor as herein provided.

    (b)

    In addition to, or independent of, the penalties provided above, the city may bring a civil proceeding in a court of competent jurisdiction to enforce compliance with the terms of the chapter or to prevent, restrain or abate any violation of the terms of the chapter. Any violation of the terms of this chapter is declared to be a public nuisance and, instead of or in addition to any other criminal or civil enforcement measure authorized by this section, may be abated by the city as other nuisances are abated under authority of the City Charter and applicable State law.

    (c)

    Neither this section, nor any other provision of this chapter, is intended to create a private right of action by or against any person or entity. This chapter is regulatory in nature, under the police power of the city, and may be enforced only by the city, through the means identified in this section.
