§ 21.3-2. Application.

  • All applicants for sidewalk use and display permits must complete an application form approved by the city and submitted to the redevelopment manager. All applications shall include the following information:

    (a)

    A dimensioned plan drawn to scale and done in a professional manner showing sidewalk and all public improvements such a light posts, benches, planters, trees, tree grates, location of the curb in relation to the building, and the proposed location of all display furniture, furniture described by height, color and type of materials, that are to be placed on the sidewalk. Plans must be submitted to the city on the form provided.

    (b)

    Insurance requirements. Encroachment permitted in the rights-of-way must be covered by liability insurance by the permit holder. The City of Glendale must be named as an additional insured on the applicant's existing liability insurance policy (does not require a separate policy) and is to be posted with a current certificate of insurance. The certificate of insurance must clearly indicate the City of Glendale is named as an additional insured on the insurance policy of the permit holder to the encroachment(s) permitted by the city. The certificate of insurance must be attached to a cover letter that clearly states that this document is being submitted in conjunction with an application for a sidewalk use and display permit.

    The certificate of insurance shall satisfy the following requirements:

    (1)

    File the certificate with the City of Glendale at the address listed below. A certificate is to be filed each time the policy renews, is replaced, expires, or is cancelled (Accord Form 25).

    (2)

    The certificate must state that the issuing company will mail a written notice to the certificate holder of any changes or cancellations of the policy within thirty (30) days.

    (3)

    Declare the limits of coverage in the amount not less than the minimum required: one million dollars ($1,000,000.00).

    (4)

    The certificate must state that the City of Glendale, a municipal corporation, its agents, officers, employees and volunteers are additionally insured as with respect to the permitted use. The permit number of the certificate must be clearly shown.

    (5)

    This permit shall include coverage for casualty, products liability, and operations hazard coverage.

    (6)

    Provide name and address of the certificate holder as:

    (c)

    A signed indemnification statement on a form provided by the city.

    (d)

    Furniture items (sometimes referred to herein as "items") may include the following: chairs, benches, tables, trash receptacles, ashtrays, planters, hanging baskets, or other display items of a character, nature, material, and neutral color conducive to an attractive outdoor display atmosphere as may be determined by the City of Glendale.

    (e)

    All permit applications must be approved by the city's redevelopment manager and Code compliance manager prior to any item being placed on the sidewalk.
