§ 10-37. Reports.

  • (a)

    No later than April 30 of each year or one hundred twenty (120) days after the close of a licensee's fiscal year, a licensee shall provide written reports to the city which shall include:

    (1)

    Full financial statements for the previous year, including an income statement, balance sheet, cash flow statement and appropriate explanatory footnotes, for the licensee or any parent company. Financial statements for the licensee or any parent company shall be audited by an independent certified public accountant, and all other statements shall be certified by an officer of the licensee to be an accurate reflection of the licensee's books and records.

    (2)

    A report, compiled as to subsections b. and d. of this section 10-37(a)(2) with due regard for public disclosure of confidential information to competitors and certified as being correct by an officer of the licensee, that includes the following information specific to the city:

    a.

    Gross revenues from each source attributable to the cable operations of the licensee;

    b.

    A summary of the previous year's major activities applicable to its video operations, including the total number of subscribers for services authorized by its license, the number of homes passed, miles of cable plant, a description of other significant system facilities or equipment added or deleted, a description of any services added or dropped and any significant technological changes occurring in the cable system;

    c.

    A summary of the number and nature of complaints received and handled; and

    d.

    Projected plans for the future.

    (b)

    A licensee shall provide the city upon its request with a written report of any performance tests performed for its cable system no later than thirty (30) days after the completion of such tests. The city may establish a performance testing process to supplement the F.C.C. standards.

    (c)

    A licensee shall prepare and furnish to the city, at the times and in the form prescribed, such additional reports with respect to its cable operations and system as the city may reasonably request in order to review the performance of the licensee in connection with its license.
